USACE, Detroit District, announces the availability of its Record of Decision (ROD) for the Enbridge Line 5 Tunnel Project, which documents its decision regarding Enbridge’s application. The ROD summarizes USACE’s analysis, presents its findings, and documents compliance with applicable laws, regulations, and policies, including Section 7 of the Endangered Species Act, Section 106 of the National Historic Preservation Act, and USACE’s Tribal trust responsibilities. Based on its review, USACE determined that the Project was not contrary to the public interest, complied with the Section 404(b)(1) Guidelines, and would not abrogate or impermissibly impair Tribal treaty rights. Therefore, the USACE provided an initial proffered permit to Enbridge, which, if accepted and signed by Enbridge, would authorize regulated activities associated with the Project.
